Online claims require the unique ID and PIN from the settlement notice. Claims for unreimbursed out-of-pocket losses must include supporting documents such as receipts and bank/credit card statements showing unreimbursed fees or fraudulent charges, invoices for services, and other documentation of identity theft or fraud tied to the breach. Lost-time claims require a brief written description of how the claimant spent the time related to dealing with the data breach.

Settlement Summary

In February 2024, EMM Loans LLC suffered a targeted cyberattack that exposed customers’ personally identifiable information, including names and sensitive identifiers such as Social Security numbers, driver’s license and state ID details, and passport numbers. The incident affected at least 2,313 people in the U.S., and those who received notice of the breach may be eligible to claim benefits from a class action settlement. Eligible claimants can choose between two years of fraud-focused credit monitoring or reimbursement for certain documented economic losses—such as costs related to identity theft, credit freezes, replacing IDs, and other unreimbursed expenses—plus compensation for limited lost time spent addressing the breach. If they don’t submit an economic-loss claim, they may instead qualify for a one-time $50 alternative payment. The lawsuit was filed because the plaintiff alleged EMM Loans failed to adequately safeguard customer data after the breach, a concern that matters to consumers and companies alike when personal identifiers are exposed. While EMM Loans denies wrongdoing, it agreed to settle to avoid the cost and uncertainty of further litigation, and the settlement’s significance is that it can provide prompt, structured relief for affected individuals rather than leaving damages to individual lawsuits. This case also reflects a broader industry pattern: as cyberattacks on financial and lending platforms become more common, class actions often follow when companies cannot prevent unauthorized access or quickly contain its impact. In the U.S., similar disputes frequently involve expectations shaped by privacy and security regulations and guidance, including the Gramm-Leach-Bliley Act for financial institutions, state data-breach notification laws, and evolving “reasonable security” standards discussed by regulators and courts, making settlements like this one a key outcome for customers seeking compensation after a breach occurs.
